The Working group on legal risks in Reflective society aims at coordinating the five sectorial Working groups and develop a common approach to legal risks in EU law.

The diversity of national interests, values and identities may conflict with the application of EU law that should be uniform and effective. Such a different and even contradictory implementation of EU law may create legal risks. On the other hand, the EU regulatory power may constitute a legal risk for the diversity of the Member State.

This Working group will especially analyse national, comparative and EU law to understand the different legal concepts. It will focus on legal risks that may arise with the protecion of national identifies deriving from EU harmonisation or approximation of legislations. It will also study how new competences of the EU under the Lisbon Treaty are affected by such reflections and whether they can be overcome by reinforced cooperation or reformulation of the original proposal.
